This legal quirk, once identified, is being used, such to gut the intent, of the U.S. bankruptcy law, while this law is being applied, for Chrysler Corporation and General Motors Corporation.
These corporations' bondholders, equity shares holders and secured receivables holders are being compensated, with little or nothing, as the miscreant processes are being completed. Shame on Bama Boy!
The old theory, which is stating: two wrongs do make a right, is being revived, now. This revival is in response, for the hue and cry, which is forthcoming, from greedy, selfish and silly auto dealers, which fester, within the USA.
These, specific dealers are not wanted, as business partners, by the, newly incarnated, versions, of General Motors and Chrysler.
The two wrongs make a right axiom is being advanced, via an amendment, which is included, in the Financial Services spending bill, H.R. 3170.
This amendment is being fostered, via the efforts of

As always, The Baby Boomer News is holding, the opinion: elimination, of the sales, via car dealers methodology, is enhancing, the chances; the new GM and new Chrysler are being successful.
Direct to the consumer, new vehicle sale, via the web portion of the internet, is feasible.
Multiple, auto manufacturers' owning and operating, vehicle service facilities, throughout the USA, is feasible.
The mandating, such that auto auctions are being open, to the general public, for the buying and selling, of vehicles, is feasible.
What is necessary: the elimination, of the individual states' franchise laws. These franchise laws do prevent, the direct sale of motor vehicles, to the general public, from the auto manufacturers.
Boomers are, correctly, lobbying, their respective, elected, state representatives, for this elimination, of the state franchise laws.
